Rental Policy and Agreement
|
|
|
|
This agreement constitutes a contract between the guest(s) and Mountain Paradise
, Inc (MP). MP serves as the agent and representative of owners of rental cabins in our rental
program and is acting at all times in, and for, the best interests of the owners.
MP agrees to rent owners property according to contract and lease said
property(s) to guest(s) per this contract. In return the guest agrees to pay all fees timely and in the manner accepted in this contract, abide by all house rules and governmental laws, and guest agrees to not relet property or assign other rental rights without prior written approval of MP. The guest acknowledges that failure to abide by any portion of this contract constitutes a breach of this contract.
CABIN DESCRIPTIONS AND RATES Information regarding the individual cabins is believed to be accurate but cannot be guaranteed. We have made every effort to ensure that all the information on MPs website is current and accurate. The possibility of errors and omissions does exist. We will be happy to confirm all the information or answer any of your questions prior to booking your reservation. Rates, furnishings, fees and taxes are subject to change without notice. Rates for daily and weekly stays are found on our website at
www.mountainparadisecabins.com. These rates are based on 2 or 4 persons dependent upon the cabin and vary dependent upon time of year (holidays, vacation season, etc.). Minimum night requirements also vary dependent upon time of year and are illustrated on our website. MP reserves the right to discount prices for any reason to include but not limited to large groups, extended stays, season, or professional affiliations.

|
ALCOHOLIC BEVERAGE The guest(s) agrees to abide by state law
prohibiting illegal consumption of alcohol on the cabin property by minors.
Furthermore, guest(s) agrees to not allow glass containers outside of the cabin. |
|
|
|
ALL GUESTS must be registered and accounted for on the Reservation Form.
Absolutely no additional visitors are allowed on the property
without written consent from MP.
|
|
|
|
CHECK-IN - Cabins are normally available after 4:00pm. Keys are not
available until the rental cabin is ready for occupancy. MP will
use all reasonable efforts to have the cabin ready for guest
occupancy at check-in time, but MP cannot guarantee the exact
time of occupancy. |
|
|
CHECK-OUT - Prior to 10 AM. Please be prompt as to allow adequate time to prepare the cabin for the next
guest(s). Please return all keys to MP before leaving to avoid additional charges. |

Inform the Office you are ready to check out. The
office will supply you with disposition instructions for the cabin
key. |

Follow the Check-out procedures to ensure additional charges are not placed on
your credit card. |

Lock all windows and doors. |
|
|
|
CANCELLATION If a Guest cancels 45 days or more prior to the arrival date,
a full refund (minus the non-refundable Reservation FEE) will be
provided. If a Guest cancels Thirty (30) days (but not
less than 15 days) prior to their arrival date NO REFUND
will be made unless MP can relet the property. If MP successfully relets the same property,
the 75% of the deposit will be refunded minus the
Cancellation Fee ($75.00). Cancellations must be in writing and sent by certified mail

CONFIRMATION Confirmation of the reservation will be mailed, faxed or emailed to
the person making the reservation upon receipt of the reservation deposit and a signed reservation agreement form. Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations. Report any errors to MP within seven (7) days of mailing. Pay close attention to the number of persons on the confirmation. Occupancy is limited to REGISTERED GUESTS ONLY. Absolutely no
other visitors are allowed without prior written consent by MP.

FURNISHINGS & EQUIPMENT All cabins are privately owned with furnishings and equipment provided by the cabin owner. MP cannot make any changes to this. Moving of furniture is prohibited. If you require special appliances or equipment, please bring them with you. Decor, style, color and themes will vary between cabins. Furnishings are subject to change without notice. |

HOUSE PARTIES ARE NOT ALLOWED Guest(s) understands that MP will accept responsible adults over the age of 25 only. Guest(s) agree that no more than the number of persons listed on the reservation agreement shall occupy the premise overnight. If the unit is occupied by more than the number of persons stated on the reservation, the result will be a loss of total rent, security deposit and/or additional charge to your credit card. Guests shall not disturb or offend any neighbors, discharge firearms, enact loud or obnoxious noises, or use fireworks of any kind in accordance with State of Georgia and applicable County
laws. Mountain Paradise Cabins, Inc. reserves the right to refuse service to anyone. All rental cabins are leased without regard to race, color, religion, sex, sexual orientation, national origin or handicap. |

KEYS Our rental cabins are privately owned and Guests are responsible for lost keys. The property must be re-keyed in the event the keys are lost, misplaced or not returned.
In such cases, you will be responsible for the cost of this procedure. |

NO-SHOW POLICY The total amount of the reservation (including the reservation fee and any applicable pet fees) will be
charged. |
| |
|
PETS Please let us know if you would
like to reserve a Pet-Friendly cabin. Not all of our cabins
allow for a pet(s). Pet fees: 1) $30/pet flat fee for 2-night stays, 2) $10/pet per night for 3-4 night stays, 3) $50/pet for each week. Pets must be housed in a crate inside of the cabin when Guests are away from cabin. There is a pet deposit of $150 that will be returned to
Guest(s) within 7 days of departure, if no damage is present. All pets must be leashed when outside the cabin and no dangerous animals are permitted. If you have a pet and it is not listed on the reservation agreement, your immediate eviction and loss of all rents and security deposit will result. Prior
written consent is required to bring a pet onto cabin property. Pets are not allowed on furniture or bedding.

REFUNDS / RATE ADJUSTMENTS are not made for any inconvenience due to construction noise, road repairs, early departures, delayed arrivals or reducing the number of nights reserved with less than 30 days notice, unless otherwise stated in this contract or subsequently agreed to in writing by legal addendum. No refunds or reschedules due to inclement weather. |

REPAIRS / SERVICE CALLS MP cannot guarantee against mechanical failure of heating, air conditioning, Hot Tubs, TVs, Satellite Receivers,
VCR/DVD players or other appliances. Please promptly report any equipment that is not operating properly. MP will make every effort to resolve the problem
as reasonably soon as possible. Should a repairperson make a call to a cabin and find the equipment in working order and the problem was due to
Guest(s) oversight or neglect, the charge for the service will be charged to the
Guest(s). All normal maintenance repairs must be reported to MP between 9 AM and 5 PM. Emergency Repair items (heating, water, etc.) may be reported 24 hours a day.
Guest(s) understand and agrees to allow MP or its repair people immediate access to the cabin for the purpose of making the repair. |

RETURNED CHECKS A $50 service charge will be incurred for any returned checks. |
| |
|
SMOKING Smoking is not permitted inside any cabin. Outside smoking is, but we are an environmentally conscious business so please extinguish your tobacco thoroughly and place residue in a trash receptacle. |

|
SPAS/HOT TUBs - The Spa cover must be in place and latched when the hot tub is not in use.
Children under the age of 18 are not allowed to use the hot tub without constant adult supervision.
Temperature of the hot tub should NEVER be elevated above 104 degrees. Pregnant woman and young children should not use the hot tub without first consulting a physician. Persons with injuries or medical conditions should consult a physician prior to using the hot tub.
Extreme care should be taken to ensure that hair and clothing does not become entangled in the
drain(s). Pets are never allowed in the hot tub. |

TAXES AND FEES A non-refundable Reservation fee
($55) is required for all rentals. The fee is non-refundable even in the event of a valid cancellation.
By Law, MP will collect 7% state tax and 3% county tax on all
rental charges.

|
TERMINATIONS BY OWNER/SUBSTITUTIONS MP strives to comply with your reservation requests, however, due to uncontrollable circumstances beyond our control, changes in ownership, properties being removed from the rental program, mechanical problems, etc. we cannot absolutely guarantee a specific cabin. MP reserves the right to change your cabin without notice or liability should the cabin become unavailable. The guest agrees not to hold the owner or MP liable for events beyond their control which may interfere with your visit. This may include but not limited to Acts of God, acts of Governmental agencies, fire, war, inclement weather and construction noise. The guest agrees MP and/or owner is not obligated to rebate or refund any fee in these circumstances, but MP will offer a comparable cabin at the same rate if available. MP will give as reasonable amount of notice as possible so other arrangements can be made. |

CREDIT CARD I, the Guest, am presenting this credit card and/or number as a guarantee and swear that I am authorized to use this card for the purpose of securing or renting said property. I agree to pay all rent and fees, accept all terms of this reservation agreement and accept all liability for any damage beyond normal wear and tear during the term of my lease with
Mountain Paradise Cabins, Inc. If I fail to do so, I authorize that these costs be charged to my credit card and agree that all credit card sales are final unless otherwise protected by
law. Please read, sign, keep a copy for your records. By signing this, I have read and fully agree to all the above policies and to hold harmless from any responsibility or liability, MP, Cabin owners and their representatives resulting from any loss, damage or personal injury incurred by any Guest on the rental cabin premise. |
